1. Who we are
Fibonacci Notes is a project of Fibonacci Impact and is provided by Fibonacci Impact LLC, Sharjah Media City (Shams), Sharjah, United Arab Emirates (“we”, “us”). These terms apply between us and everyone who creates an account or uses Fibonacci Notes (“you”), and to schools and companies that agree a plan with us.
2. The service
Fibonacci Notes is a hosted notes app: handwritten notebooks, imported PDFs and pictures, kept in your account and synced across your devices. The web app is available at notes.fib.im/app/; the iPad app is in early access and is offered to the people we invite. The service is new: features may change, and we tell you in advance about any change that removes something you use.
If you are under 18, or under the age of majority where you live, use Fibonacci Notes only with the permission of a parent, guardian or your school.
3. Plans and billing
- The Free plan is free of charge within its limits (currently 5 notebooks and 1 GB of storage), which we may change with notice. Reaching a limit never deletes what you have.
- Plans with higher limits are agreed with us in writing (by email is enough): the limits, the price and the billing period. There is no online checkout.
- We invoice paid plans in advance for each billing period. Invoices are due within the time stated on them. Taxes such as VAT are added where they apply.
- If an invoice stays unpaid after a reminder, we may return the account to the Free plan’s limits until it is paid. Your notebooks stay readable and exportable.
4. Your account
You sign in with a Fibonacci account (Fibonacci single sign-on, at auth.fib.im). Keep your sign-in details to yourself; you are responsible for what is done with your account. Tell us at once at hello@fib.im if you think it has been misused.
5. Your notes
- What you write, draw, type, import or upload is yours. You give us only the permission we need to store it, sync it to your devices, process it for features such as search and export, and back it up. We do not use it for anything else, as described in the Privacy Policy.
- You are responsible for having the right to upload what you import, such as PDFs, planners and pictures, and for not storing material that is unlawful.
- You can export any notebook or page as a PDF at any time. When you close your account, we delete your notes within a reasonable time, unless the law requires us to keep part of it.
6. Acceptable use
Do not use the service to break the law, to store or share material you have no right to, to probe or overload the service, or to get at other people’s accounts. We may suspend access that puts the service or other people at risk, and we will tell you why.
7. Availability and support
We work to keep the service available and your notes safe, but we do not promise uninterrupted service. Keep your own exports of anything you cannot afford to lose. Support is by email and WhatsApp. Any service levels agreed for a paid plan are the ones written into that agreement.
8. Liability
The service is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability in any twelve months is limited to the amount you paid us for the service in that period. Nothing here limits liability that cannot be limited by law, or your rights as a consumer.
9. Ending the service
You may stop using the service and ask us to close your account at any time; a paid plan runs to the end of its billing period unless we agree otherwise. We may end the service for you with reasonable notice, or straight away for a serious breach of these terms.
10. Law and disputes
These terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Sharjah. We will first try to settle any dispute by talking; failing that, the courts of Sharjah, United Arab Emirates have jurisdiction, without taking away any right you have as a consumer to bring a claim where you live.
11. Changes and contact
We may update these terms; for a change that matters we tell you by email or in the app before it applies. Questions: hello@fib.im.
